Privacy Policy

SkillNode ("we," "our," or "us") is committed to protecting your privacy. This Privacy Policy explains how your personal information is collected, used, and disclosed by SkillNode, and applies to our website, its subdomains, and our application.

Definitions and key terms

To help explain things as clearly as possible, the following terms are used:

  • Cookie: a small amount of data generated by a website and saved by your web browser, used to identify your browser, provide analytics, and remember information about you such as language preference or login information.
  • Company / we / us / our: SkillNode, responsible for your information under this Privacy Policy.
  • Country: the country where SkillNode is based — Canada.
  • Customer: the company, organization, or person that signs up to use the SkillNode Service.
  • Device: any internet-connected device such as a phone, tablet, or computer used to visit SkillNode.
  • IP address: the unique number assigned to your internet-connected device, which can identify the general location from which you connect.
  • Personnel: individuals employed by SkillNode or under contract to perform services on our behalf.
  • Personal Data: any information that directly, indirectly, or in combination with other information allows the identification of a natural person.
  • Service: the services provided by SkillNode as described on our platform and in the applicable terms.
  • Third-party service: advertisers, contest sponsors, promotional and marketing partners, and others who provide our content or whose products or services we think may interest you.
  • Website:SkillNode's site, accessed at skillnode.ca.
  • You: a person or entity registered with SkillNode to use the Services.

What information do we collect?

We collect information from you when you visit our website, register on our site, place an order, subscribe to our newsletter, respond to a survey, or fill out a form, including:

  • Name / username
  • Phone numbers
  • Email addresses
  • Mailing addresses
  • Job titles
  • Billing addresses
  • Debit / credit card numbers
  • Age
  • Password

We may also collect information from mobile devices to improve your experience. These features are completely optional:

  • Location (GPS): helps create an accurate representation of your interests so we can bring more relevant matches and ads.
  • Phonebook (Contacts list): makes the platform easier to use by saving you from manually entering contacts.

When does SkillNode use end-user information from third parties?

SkillNode will collect End User Data necessary to provide the SkillNode services to our customers. End users may voluntarily provide us with information they have made available on social media websites. If you provide us with such information, we may collect publicly available information from those websites. You can control how much of your information social media websites make public by visiting those sites and changing your privacy settings.

When does SkillNode use customer information from third parties?

We receive some information from third parties when you contact us. For example, when you submit your email address to show interest in becoming a SkillNode customer, we receive information from a third party that provides automated fraud detection services. We also occasionally collect information made publicly available on social media websites.

Do we share the information we collect with third parties?

We may share the information we collect, both personal and non-personal, with third parties such as advertisers, contest sponsors, promotional and marketing partners, and others who provide our content or whose products or services we think may interest you. We may also share it with current and future affiliated companies and business partners, and — if we are involved in a merger, asset sale, or other business reorganization — with our successors-in-interest.

We may engage trusted third-party service providers to perform functions for us, such as hosting and maintaining our servers, database storage, email management, marketing, credit card processing, customer service, and order fulfillment. We share personal and non-personal information with these third parties as necessary to perform these services.

We may share portions of our log file data, including IP addresses, with analytics partners, application developers, and ad networks for analytics purposes. If your IP address is shared, it may be used to estimate general location and technographics such as connection speed and device type.

We may also disclose information to government or law-enforcement officials or private parties where we believe necessary or appropriate to respond to legal process, protect our rights or interests, ensure the safety of the public, or comply with applicable laws.

Where and when is information collected?

SkillNode collects personal information that you submit to us. We may also receive personal information about you from third parties as described above.

How do we use the information we collect?

Any of the information we collect from you may be used to:

  • Personalize your experience and better respond to your individual needs
  • Improve our website based on the information and feedback we receive
  • Improve customer service and effectively respond to your support needs
  • Process transactions
  • Administer contests, promotions, surveys, or other site features
  • Send periodic emails

How do we use your email address?

By submitting your email address on this website, you agree to receive emails from us. You can cancel your participation in any of our email lists at any time using the opt-out link included in each email. We only send emails to people who have authorized us to contact them. By submitting your email address, you also agree to allow us to use it for customer audience targeting on sites like Facebook, where we display custom advertising to people who have opted in to receive communications from us. Email addresses submitted only through the order-processing page will be used solely to send order-related information.

How long do we keep your information?

We keep your information only as long as we need it to provide SkillNode to you and fulfill the purposes described in this policy. The same is true for anyone we share your information with who carries out services on our behalf. When we no longer need to use your information and have no need to retain it for legal or regulatory reasons, we either remove it from our systems or depersonalize it so you can no longer be identified.

How do we protect your information?

We implement a variety of security measures to maintain the safety of your personal information. All sensitive information is transmitted over SSL and stored in our payment gateway providers' databases, accessible only to those with special access rights, who are required to keep the information confidential. After a transaction, your private information (credit cards, financial details, etc.) is not kept on file. We cannot, however, warrant the absolute security of any information you transmit or guarantee that information on the Service cannot be accessed, disclosed, altered, or destroyed by a breach of our physical, technical, or managerial safeguards.

Could my information be transferred to other countries?

SkillNode is incorporated in Canada. Information collected via our website or services may be transferred from time to time to our offices or personnel, or to third parties, located throughout the world, and may be hosted anywhere in the world, including countries that may not have laws of general applicability regulating the use and transfer of such data. To the fullest extent allowed by applicable law, by using SkillNode you voluntarily consent to such trans-border transfer and hosting.

Is the information collected secure?

We take precautions to protect the security of your information using physical, electronic, and managerial procedures. However, no security system is foolproof. While we use reasonable efforts to protect your personal information, we cannot guarantee its absolute security. If applicable law imposes a non-disclaimable duty to protect your information, you agree that intentional misconduct will be the standard used to measure our compliance with that duty.

Can I update or correct my information?

The rights you have to request updates or corrections depend on your relationship with SkillNode. Customers may contact us to:

  • Update or correct your personally identifiable information
  • Change your communications preferences
  • Delete the personally identifiable information maintained about you on our systems (by cancelling your account)

To protect your privacy and security, we may take reasonable steps (such as requesting a unique password) to verify your identity before granting profile access or making corrections. You are responsible for maintaining the secrecy of your password and account information.

You should be aware that it is not technologically possible to remove every record of information you have provided to us from our system, since backups may retain a non-erasable copy. Promptly after receiving your request, all personal information stored in databases we actively use and other readily searchable media will be updated as soon as and to the extent reasonably and technically practicable.

If you are an end user and wish to update, delete, or receive any information we have about you, you may do so by contacting the organization of which you are a customer.

Sale of business

We reserve the right to transfer information to a third party in the event of a sale, merger, or other transfer of all or substantially all of the assets of SkillNode or any of its Corporate Affiliates, or in the event that we discontinue our business or are subject to bankruptcy or similar proceedings, provided that the third party agrees to adhere to the terms of this Privacy Policy.

Affiliates

We may disclose information (including personal information) about you to our Corporate Affiliates. For purposes of this Privacy Policy, "Corporate Affiliate" means any person or entity that directly or indirectly controls, is controlled by, or is under common control with SkillNode. Any information relating to you that we provide to our Corporate Affiliates will be treated by those Affiliates in accordance with this Privacy Policy.

Governing law

This Privacy Policy is governed by the laws of Canada without regard to its conflict of laws provisions. You consent to the exclusive jurisdiction of the courts in Canada in connection with any action or dispute arising under or in connection with this Privacy Policy.

Cookies

SkillNode uses cookies to identify the areas of our website you have visited. Cookies enhance the performance and functionality of our website but are non-essential to its use. However, without these cookies certain functionality may become unavailable. We never place personally identifiable information in cookies. See our Cookie Policy for full details.

Remarketing services

We use remarketing (retargeting) services. Remarketing is the practice of serving ads across the internet to people who have already visited our website, allowing us to reach users on the platforms they use most.

Payment details

In respect to any credit card or other payment processing details you have provided us, we commit that this confidential information will be stored in the most secure manner possible.

Kids' privacy

We do not address anyone under the age of 13. We do not knowingly collect personally identifiable information from anyone under 13. If you are a parent or guardian and become aware that your child has provided us with Personal Data, please contact us. If we become aware that we have collected Personal Data from anyone under 13 without verification of parental consent, we will take steps to remove that information from our servers.

Changes to our Privacy Policy

We may change our Service and policies, and we may need to update this Privacy Policy. Unless otherwise required by law, we will notify you (for example, through our Service) before making changes and give you an opportunity to review them before they take effect. If you continue to use the Service after the changes, you will be bound by the updated Privacy Policy. If you do not agree, you can delete your account.

Third-party services

We may display, include, or make available third-party content or links to third-party websites or services. SkillNode is not responsible for any Third-Party Services, including their accuracy, completeness, validity, legality, decency, quality, or any other aspect. You access and use them entirely at your own risk and subject to those third parties' terms.

Tracking technologies

  • Google Maps API: may collect information from you and your device for security purposes and is held in accordance with its own Privacy Policy.
  • Cookies: used to enhance performance and functionality.
  • Local storage: provides client-side data storage with greater capacity than cookies.
  • Sessions: used to identify the areas of our platform you have visited.

GDPR (European Economic Area)

If you are in the European Economic Area, the GDPR gives you specific rights regarding your personal data. GDPR is an EU-wide privacy and data protection law that regulates how EU residents' data is protected by companies and enhances the control EU residents have over their personal data.

Data Protection Principles include:

  • Personal data must be processed in a fair, legal, and transparent way and only used in a way that a person would reasonably expect.
  • Personal data should only be collected for a specified purpose and only used for that purpose.
  • Personal data should be held no longer than necessary.
  • People covered by the GDPR have the right to access, copy, update, delete, restrict, or move their data to another organization.

Individual data-subject rights — access, portability, deletion

We are committed to helping our customers meet GDPR data-subject-rights requirements. SkillNode processes or stores all personal data in vetted, DPA-compliant vendors. We store all conversation and personal data for up to 6 years unless your account is deleted. If you delete your account, we will dispose of your data in accordance with our Terms and this Privacy Policy and will not hold it longer than 60 days.

California residents (CCPA)

The California Consumer Privacy Act (CCPA) requires us to disclose the categories of Personal Information we collect, how we use it, the categories of sources we collect from, and the third parties we share it with — all explained above.

California residents have the following rights:

  • Right to Know and Access — request information about the categories of Personal Information we collect, the purposes, the sources, and the specific pieces we have collected about you.
  • Right to Equal Service — we will not discriminate against you for exercising your privacy rights.
  • Right to Delete — request that we close your account and delete the Personal Information about you we have collected.
  • Right to opt out of sale — request that we not sell your personal data.

If you make a request, we have one month to respond. We do not sell the Personal Information of our users.

California Online Privacy Protection Act (CalOPPA)

CalOPPA users have the same Rights to Know, Equal Service, Deletion, and the right to request that we not sell their personal data. We do not sell the Personal Information of our users. If you make a request, we have one month to respond.
